This Privacy Policy (hereinafter referred to as “Policy”) is a policy statement for La Vertu Coton (hereinafter referred to as “Shop”) that applies to the information collected and stored by the Shop that is acquired through the services made available by the Shop. The services are, including, however not limited to: sales of art, shipment and any other accompanied services (hereinafter referred to as “Services”). The Shop, through the Services, acquires the information, including, however not limited to: a full name, date of birth, contact details, images and any other information that could identify a specific individual; the personal information, including, however not limited to the information related to the identification of a user; and activity logs on communication services, and any other information generated or accumulated in relation to a user or user’s computer, mobile device or other devices (all of the above hereinafter referred to as “User Information”).
The Shop shall handle the User Information in accordance with this Policy.
1. Proper Acquisition
The Shop shall acquire the User Information in a proper manner at any time in accordance with the relevant laws and regulations, including, however not limited to: the Act on the Protection of Personal Information (hereinafter referred to as “Act”); and the guidelines published by the Ministry of Economy, Trade and Industry.
The User Information acquired is used within the purposes of utilisation that are stipulated in paragraph three of this Policy. The Shop shall maintain the User Information acquired to be accurate and up to date within the scope necessary for the paragraphs in and after paragraph three of this Policy. The Shop also shall take necessary and proper measures for the prevention of leakage, loss, or damage of the User Information.
2. The User Information to be Collected and Methods of Collection
Based on the collection methods, the User Information that the Shop collects and stores through the Services is as follows:
(1) Information Provided by a User
In order for a user to use the Services, the user will be required to provide the following information:

・PayPal related details;
・Bank account details (only required for a refund).
(2) The User Information Collected by the Shop
The Shop may collect logs and data of access to the Services and other information relating to the usage of the Services by a user which includes the following:

・Device location information;
・Use of Google Analytics.
The Shop uses Google Analytics, a service of Google, Inc. to measure the website for improvements of the Services. When Google Analytics analyses the data through the cookies* generated, Google, Inc. may collect part of the User Information, including, however not limited to IP addresses. The User Information collected through Google Analytics is used only for the purposes for analysing the usage and behaviour of visitors to a specific website, for generating analysis reports to a manager of the website, and for the provision of the other services. By using the Services made available by the Shop, the user is deemed to accept that Google Inc. processes the User Information collected by the above-mentioned methods and collected for the above-mentioned purposes through Google Analytics.
*Please note: the cookies do not include any information that can identify a specific individual. Users can disable the cookies on their internet browsers if they wish to. However, disabling the cookies may make some of the features provided by the Shop unavailable.
3. Purposes of Utilisation
The Shop handles the User Information within a range of purposes stipulated following:
The User Information Relating to Customers and Suppliers:
(1) For registration, account management, provision of the Services, and fee calculations relating to the Services, and for improvements, and maintenance of the Services;
(2) For responding to enquiries, guidance, and feedback relating to the Services;
(3) For taking action against the acts of breach of the Shop’s Terms and Conditions, this Policy and any other policies (hereinafter referred to as “T&C and Policy”);
(4) For notifying users of any changes to the T&C and Policy;
(5) For sending users Emails, direct mail or other messages relating to the Services provided by the Shop where the user has provided the consent of receipt;
(6) For verifying the identification of a user in order to take actions related to the User Information relating to the user. Those actions are, including, however not limited to: public announcement, disclosure, addition, correction, discontinuance of use, deletion upon the request by the user;
(7) For the uses as per terms of a contract entered by the Shop and a person who provided of his or her User Information (hereinafter referred to as “Person”);
(8) Any other accompanied purposes relating to the purposes stipulated above.
4. Provision or Sharing of the User Information with a Third Party
The Shop shall not provide and disclose the User Information to, or share the User Information with a third party without the prior consent of the Person, except in the following cases stipulated in the Act:
(1) Cases in which the provision of personal data is based on laws and regulations;
(2) Cases in which the provision of personal data is necessary for the protection of the life, body, or property of an individual and in which it is difficult to obtain the consent of the person;
(3) Cases in which the provision of personal data is specially necessary for improving public health or promoting the sound growth of children and in which it is difficult to obtain the consent of the person;
(4) Cases in which the provision of personal data is necessary for cooperating with a state organ, a local government, or an individual or a business operator entrusted by one in executing the affairs prescribed by laws and regulations and in which obtaining the consent of the person are likely to impede the execution of the affairs.
5. Restrictions on Acquisition of Certain Sensitive Personal Information
The Shop shall not acquire, use or provide the User Information that contains the following:
a) Matters related to a thought, creed or religion;
b) Matters related to a race, ethnic group, family origin, registered domicile (excluding the information about prefecture of residence), physical or mental disorder, criminal history, or any other matters which may cause social discrimination;
c) Matters related to the right of workers to organise and bargain collectively, and any other acts of collective action;
d) Matters related to participation in any mass demonstration, exercising the right of petition or any other political rights;
e) Matters related to health care or sexual life.
However, the above requirement shall not apply in the cases in which the Person explicitly consents to such acquisition, use or provision and in any of the following cases:
(1) Cases in which the acquiring of personal information is based on laws and regulations;
(2) Cases in which the acquiring of personal information is necessary for the protection of the life, body, or property of an individual and in which it is difficult to obtain the consent of the person;
(3) Cases in which the acquiring of personal information is specially necessary for improving public health or promoting the sound growth of children and in which it is difficult to obtain the consent of the person;
(4) Cases in which the acquiring of personal information is necessary for cooperating with a state organ, a local government, or an individual or a business operator entrusted by either of the former two in executing the affairs prescribed by laws and regulations and in which obtaining the consent of the person is likely to impede the execution of the affairs concerned.
6. Amendments to the Purpose of Utilisation
In cases of any amendments to the purpose of utilisation stipulated in paragraph one of this Policy, the Shop shall notify the Person in advance or publish through the Shop’s website (URL: https://ninomiya-sontoku.jp/).
However, the above requirement shall not apply in the following cases stipulated in the Act:
(1) Cases in which notifying the person of the Purpose of Utilization or publicly announcing it are likely to harm the life, body, property, or other rights or interests of the person or a third party;
(2) Cases in which notifying the person of the Purpose of Utilization or publicly announcing it are likely to harm the rights or legitimate interests of the business operator handling personal information;
(3) Cases in which it is necessary to cooperate with a state organ or a local government in executing the affairs prescribed by laws and regulations and in which notifying the person of the Purpose of Utilization or publicly announcing it are likely to impede the execution of the affairs.
The Shop shall make any amendments to this Policy, except for the purpose of utilisation, at any time where the Shop determines necessary. In cases that an amendment impacts significantly to users, a notice of any changes will be given in advance which is considered reasonable by publishing through the Shop’s website (URL: https://ninomiya-sontoku.jp/).
7. Management of the User Information
The Shop shall take necessary and proper measures for the appropriate management of the User Information to prevent any leakage, loss, or damage of the User Information.
(1) The Shop shall not outsource the management of the User Information acquired;
(2) The Shop’s representative shall take care of any enquiries, complaints and any other requests from a user relating to the handling of the User Information. Please refer to paragraph thirteen of this Policy for the contact details;
(3) The Shop shall continue learning and developing the knowledge of the laws and regulations including the Act and any matters which require special attention relating to the handling of the User Information.
8. Security Control Measures
The Shop shall take necessary and proper security control measures for the prevention of leakage, loss, or damage of the User Information.

9. Public Announcement and Disclosure of the User Information to the Person
Upon a request by the Person, the Shop shall publically announce and disclose all of the User Information possessed by the Shop relating to the Person without any delay.

10. Requests for Correction, Discontinuance of Utilisation and other Requests by the Person
Upon the request of the Person, the Shop shall respond to the requests, including, however not limited to: addition, correction, discontinuance of use, and deletion of the User Information relating to the Person without any delay.

11. Procedures for Verification of Identification
The Shop will request a presentation and taking a photocopy of the identification of the Person for verification purposes, in response to the requests by the Person, as per paragraph nine and paragraph ten of this Policy. Those requests are, including, however not limited to: public announcement, disclosure, addition, correction, discontinuance of use, and deletion of the User Information relating to the Person.
In the cases that the above is requested by a representative of the Person, in addition to the presentation and taking a photocopy of the identification of the Person, the Shop will request a presentation and taking a photocopy of the identification of the representative and the power of attorney signed and sealed by the Person.
In the cases that the Person or the representative of the Person who requested the above, located in a remote area, please contact the Shop as per the contract details in paragraph thirteen of this Policy. The Shop will request a scanned copy or physical copy of the above-mentioned required documentation and any other required documents, including, however not limited to, a copy of both sides of the identification of the Person and/or the representative to be sent via email to the designated email address or to be posted to the designated mailing address. 12. Return and Deletion of the User Information and Personal Data
Upon the request for return or deletion of the User Information by the Person, the Shop shall delete all of the User Information relating to the Person that has been stored in the way of a physical copy or electronic copy on the computers by the Shop without any delay. In the cases that, at the time of the above request, the Shop holds any documentation of the Person that the Shop has been looking after for the Person, the Shop shall return the documentation to the Person without any delay.
